It is the policy of the Western
Libraries Course Reserves service to comply with U. S. Copyright Law (Title
17, United States Code ).
The following types of materials
may be freely placed on Course Reserves as needed:
- materials owned by the Libraries
- personal copies of whole books and other complete materials owned by the individual faculty member
- materials created by the individual faculty member (such as exams, study guides, etc.)
- U. S. government publications (whole or in part)
In the case of materials electronically reproduced from sources not owned by the Libraries, we require faculty to certify that the appropriate Fair Use guidelines of the Copyright Law have been followed. In the event the materials are not compliant with Fair Use guidelines, we require proof that permission has been obtained from the copyright owners.
Library personnel cannot advise you on legal complicance or interpret Copyright Law. You may obtain assistance with evaluating eligibility of materials according to Fair Use, and with obtaining permission from copyright owners from:

Current Criteria for Determining Fair Use Compliance of Course Reserves Materials
Books, periodicals, music and sound recordings
Permission of the copyright owner is not required to place the following copies on Course Reserves for one quarter only:
- A chapter of a book
- An article from a periodical or newspaper
- An excerpt from any prose work
- A short story or short essay
- A poem or excerpt of a poem
- One chart, graph, diagram, drawing, cartoon, or picture per book or per periodical or newspaper issue
- No more than two published pages containing not more than 10% of the words found in "special works" containing language with illustrations, such as children’s books
- Single or multiple copies of excerpts of works provided that the excerpts do not comprise a part of the whole which constitute a performable unit, such as a section, movement or aria, but in no case more than 10% of the whole work
Permission of the copyright owner is required in order to make the following available through Course Reserves:
- Personal copies of the above items for more than one quarter
- More than one chapter of a single book
- More than one article from a single periodical or newspaper issue
- More than one selection from an anthology or collection
- More than one chart, graph, diagram, drawing, cartoon, or picture per book or per periodical or newspaper issue
- More than two published pages from "special works" containing language with illustrations, such as children’s books
- Copies for the purpose of performace

Special Rules Concerning Videos
- One copy of any commercial video not part of the Libraries’ collection and purchased by the instructor for home use may be made available through Course Reserves for in-library use only
- Homemade copies of commercial videos may not be made available through Course Reserves

Special Rules Concerning Off-Air Recordings of Television Programs
- Off-air recordings must relate directly to coursework
- Off-air recordings must be used within 10 days of the original broadcast
- The retention period for off-air recordings is 45 days, after which they must be erased or destroyed
- Off-air recordings must be used as broadcast; they may not be altered, edited, or combined with other works
- Off-air recordings of pay-per-view programming may not be made available through Course Reserves

Multi-Media
Faculty wishing to create multi-media presentations consisting of portions of copyrighted materials should consult Western’s Copyright Office (Wilson Library 562, X/7435) for specific guidelines before submitting such materials to Course Reserves services.

Coursepacks
Coursepacks containing copyrighted materials are not accepted by Course Reserves. Copyright owners will not normally grant permission for coursepacks to be placed on library reserve.
